Ini\u021biatorii precizeaz\u0103 c\u0103 proiectul \u00ee\u0219i propune s\u0103 faciliteze accesarea m\u0103surilor de restructurare la primele semne de dificultate ale societ\u0103\u021bilor, s\u0103 creeze premise pentru avertizarea timpurie a debitorilor asupra existen\u021bei unor circumstan\u021be ce ar putea conduce la insolven\u021b\u0103 \u0219i asupra necesit\u0103\u021bii de a ac\u021biona f\u0103r\u0103 \u00eent\u00e2rziere. Totodat\u0103, proiectul urm\u0103re\u0219te s\u0103 fie prevenit\u0103 ie\u0219irea din circuitul economic a companiilor viabile \u0219i s\u0103 stimuleze reluarea activit\u0103\u021bii economice a companiilor care \u00eent\u00e2mpin\u0103 dificult\u0103\u021bi financiare sau care au trecut printr-o insolven\u021b\u0103.<\/span><\/p>\n<p><span class=\"stk-highlight\">Proiectul de lege propune introducerea unei noi proceduri pre-insolven\u021b\u0103 \u2013\u00a0<em>acordul de restructurare preventiv\u0103<\/em>\u00a0\u2013 \u0219i modificarea substan\u021bial\u0103 a procedurii concordatului preventiv. \u201eNoua procedur\u0103 a fost conceput\u0103 a se adresa debitorilor afla\u021bi \u00eentr-o faz\u0103 incipient\u0103 a st\u0103rii de dificultate, \u00een care nu se resimte \u00eenc\u0103 presiunea creditorilor (prin declan\u0219area unor execut\u0103ri silite), dar \u00een care indicatorii de natur\u0103 financiar\u0103 \u0219i\/sau non-financiar\u0103 semnaleaz\u0103 deja nevoia de a interveni pentru a preveni o situa\u021bie de insolven\u021b\u0103.
